Terms & Conditions of Service  ·  Governed by Queensland Law

Definitions
📖
Booking Form
The form provided to you prior to the start of services, identifying Shaun's Moves and the services to be performed.
Contract
A contract for the performance of services as stated in these terms and conditions and the relevant Booking Form.
Dangerous Goods
Goods which are or may become dangerous, corrosive, explosive, flammable, infectious or capable of attracting pests.
Goods
All goods which are the subject of services, including any container, packaging or pallets used in connection.
Services
Services undertaken by contractors as stated on the Booking Form — may include removal, packing/unpacking or other services.
Shaun's Moves
Living the Dream Logistics Pty Ltd t/as Shaun's Moves. We, Us and Our have corresponding meanings and include each person who performs services as identified on the Booking Form.
You / Your
The person entering into a contract as the customer as identified on the Booking Form, and each person that person is authorised to represent.

Interpretation

  • The singular includes the plural, and vice versa.
  • If a word or phrase is defined, its other grammatical forms have corresponding meanings.
  • Person includes an individual, body corporate, firm, unincorporated body, society, association and authority.
  • A reference to a particular person includes their legal personal representatives, administrators, successors, substitutes and permitted assigns.
  • Costs includes charges, expenses and legal costs (on a full indemnity basis).
  • An agreement, representation or warranty by 2 or more persons binds all of them jointly and each individually.
  • A reference to a document or agreement includes that document as amended or replaced.
  • A reference to law means statute law, common law and equitable principles.
  • The meaning of any general language is not restricted by any accompanying example; includes, including, such as are not words of limitation.
  • Headings do not affect interpretation.

Preliminary

2.1

We want your move to be smooth, safe and stress-free. These Terms & Conditions explain how we work, what you can expect from us, and what we need from you on moving day.

2.2

By signing a Booking Form with Shaun's Moves prior to commencement of the services, you acknowledge and agree that you:

  • (a)Enter a contract with Shaun's Moves and each contractor named on the Booking Form in your own capacity and as agent for each person you represent (and that each such person is bound by these terms and conditions); and
  • (b)Have authority to bind each person you represent.
2.3

Neither you nor any person you represent may make any claim against Shaun's Moves (including in negligence or for breach of contract) for loss or damage arising out of, or costs incurred in connection with, the performance of any services.

2.4

You must indemnify Shaun's Moves for all liability arising out of, and all costs incurred in connection with, any claim referred to in clause 2.3 which is made despite the operation of that clause.

2.5

You may only make a claim in respect of a particular service against the particular principal contractor who provided that service. Each such claim will be governed by these terms and conditions.

Before We Get Started

3.1

We may choose not to take on certain jobs or items if they are unsafe, prohibited, unsuitable for transport, or otherwise determined to be Dangerous Goods.

3.2

You must ensure the information you provide about your move (access, load size, inventory, dates, etc.) is accurate — it helps us quote correctly and plan the right resources. You warrant the accuracy and completeness of all information provided.

3.3

Prior to us quoting and performing services, you must:

  • (a)Provide a reasonable estimate of the volume of goods to be transported or stored so we can appropriately resource the services.
  • (b)Notify us (in writing if required) of any goods which are: Dangerous Goods; inherently fragile or brittle; valued in excess of $1,000; or otherwise require special care or skill not apparent from ordinary visual inspection.
3.4

You also confirm that you own the goods being moved or have permission from the owner.

Our General Rights and Discretions

4.1

We reserve the right to refuse services for any particular person or in respect of goods of any particular class, at our sole discretion.

4.2

We are entitled, at our sole discretion, to determine the method, manner, time and route that services will be performed.

4.3

All times we provide for performing services are estimates only. We will use reasonable endeavours to adhere to such times, but we are not liable for any failure or delay.

4.4

You must ensure all goods are provided in a condition suitable for us to perform the services (including proper packing to withstand ordinary transport risks, except where you have contracted us to pack the goods).

4.5

If any information you supply at the time of booking is incorrect or incomplete, we may perform services strictly as per our quotation or vary our charges to address any additional or modified services.

Your Warranties

5.1

You warrant that:

  • (a)All goods handled by us are owned by you or a person you represent; comply with all applicable laws; and do not comprise Dangerous Goods (unless disclosed in accordance with clause 3.3(b)).
  • (b)Each principal contractor is authorised to enter all premises at which services will be performed. If you do not own those premises, you warrant that all necessary consents have been obtained.
  • (c)If, after commencement of services, we discover undisclosed Dangerous Goods — you authorise us to take any action we deem appropriate (at your expense and without liability to you) to dispose of or destroy those goods, and you indemnify us for all liabilities and costs arising.

Being Present on Moving Day

You or a trusted representative must be present at both pickup and delivery locations to confirm items, placement and access.
6.2

If no one is available and we can't deliver, your items may be placed into storage and extra charges may apply.

Removal Service

We are not common carriers and accept no liability to you as such.
7.1–7.2

You must ensure that you or an authorised representative is present when removal services are performed at both pick-up and delivery locations. You are responsible for ensuring all goods are loaded and delivered and that no goods are overlooked or another person's goods transported in error.

7.3

If we cannot deliver goods (because no one is present, access is unavailable, or for other reasons beyond our reasonable control), we may at our sole discretion: return goods to pick-up location; store goods nearby; or attempt re-delivery — with additional charges applying in each case.

7.4

We may refuse to remove items over 60kg (pianos, safes, billiard tables, etc.) if not notified at booking. Such items carry a separate charge and any damage is at your sole risk.

7.5

If requested, we may (but are not obliged to): dismantle/reassemble goods; transport items out of windows or over balconies; or remove obstructions such as doors or windows — all at additional charge and at your sole risk.

7.6

You must ensure loading docks and lifts are available and that our vehicles can access pick-up and delivery locations with adequate parking.

Storage Services

Goods stored in our facilities are at the sole risk of the customer. Shaun's Moves will not be liable for physical loss, damage, destruction or deterioration of goods for any reason — including fire, flood, theft, pests, rust, mildew or any facility defect. Stored goods are not covered under our insurance. You should arrange your own storage insurance.
8.1

If goods are stored for more than 25 weeks, we may change storage charges on at least 4 weeks' prior written notice.

8.2

We may transfer stored goods between storage locations at no cost to you, providing at least 5 days' prior notice (except in emergency).

8.3

You may inspect goods in store with reasonable prior notice; an additional charge may apply.

8.4

Provided you have paid for the entire agreed storage period, you may require goods be removed on not less than 7 days' written notice. Shorter notice may incur additional charges.

8.5

After the agreed storage period, you must remove goods within 4 weeks of written notice. If you fail to do so, we may — after a further 2 weeks' written notice — sell all or any of the goods by public or private auction and apply the proceeds against any outstanding amounts owed.

Other Services

9.1

Our standard removal services do not include packing or unpacking. If you require packing, unpacking, cleaning, locksmith or other services, you must notify us at the time of booking. Separate additional charges apply.

Items We Cannot Move

For everyone's safety, we cannot move:

  • Firearms
  • Flammable, explosive or hazardous items
  • Chemicals or corrosive materials
  • Goods that may attract pests
  • Perishable food items
  • Dangerous Goods (as defined)

If you have anything unusual, please talk to us before moving day. If dangerous goods are found later, we may dispose of them safely at your cost.

Access and Items Left Behind

11.1

You are responsible for ensuring access ways are clear and safe. Please double-check all areas of the property to ensure nothing is left behind.

Delays Outside Our Control

We do our best to run on time, but delays can occur due to:

  • Weather
  • Traffic or road closures
  • Industrial action
  • Vehicle issues
  • Limited access
  • Situations caused by third parties

Time lost due to delays outside our control is charged at the normal hourly rate.

Wet Weather, Safety & Unhygienic Conditions

13.1

We take safety seriously. In extreme weather or unsafe conditions, we may need to pause or reschedule the move to protect your belongings and our team. We may also refuse to work in unhygienic or hazardous environments.

$200 booking deposit is required to secure your booking. A 1.9% card surcharge applies.

Charges & Payments

15.3

After the minimum time, services are charged in 15-minute increments, rounded up to the nearest half hour, at standard rates (unless a fixed quote applies).

15.4

All charges (excluding storage) must be paid one hour before completion of services. Storage charges must be paid in advance.

15.5–15.6

You must pay or reimburse all third-party costs including tolls, parking costs and (where reasonable) parking fines incurred in connection with the services.

15.7

Payments may be made by cash, bank cheque, or Visa/Mastercard. A 1.9% processing fee applies to card payments.

15.10

If an amount is outstanding for more than 7 days, interest accrues daily at the Commonwealth Bank maximum personal overdraft rate plus 3%.

15.12

You will be liable for all debt collection costs, legal costs (on a solicitor/own client basis), search fees and other expenses incurred in recovering amounts owed.

If Your Move Changes

16.1

If the job takes longer, involves extra items, difficult access, delays or additional work or trucks, we'll charge for the extra time at the agreed hourly rate.

GST

17.1

All charges quoted are GST exclusive unless otherwise stated. An additional amount not exceeding 10% of the amount otherwise payable will be added in respect of GST.

Lien

18.1

All goods we hold are subject to a general lien for any amounts due to us under these or any other terms.

18.2

If amounts owed remain outstanding for 4 weeks, we will give a further 4 weeks' written notice of our intention to sell goods subject to the lien. If payment is not made within that period, we may sell any or all of the goods by public or private sale and apply the proceeds to the outstanding debt.

Insurance & Protection of Your Goods

We do not insure your personal belongings for accidental damage during loading, unloading or handling. We recommend arranging your own removals insurance — we suggest Removals Insurance Australia or any provider of your choice.
19.1

Shaun's Moves is fully insured for public liability, motor and transit risks as required by law.

Damage to Goods

We are not liable for:

  • Damage caused by packing we did not perform
  • Electrical or mechanical failure of appliances
  • Items made from fragile materials (glass, particle board, MDF, etc.)
  • Jewellery, watches, money or valuables not personally carried by you
  • Data loss or any type of consequential loss
If our team clearly causes damage, we will attempt repair or, if not possible, replacement at fair value. Any replaced item becomes property of Shaun's Moves.

Reporting timeframe: All damage must be reported within 48 hours of the move. After 48 hours, we cannot accept responsibility.

Your Responsibilities

To help us complete your move safely and efficiently, please ensure:

  • Walkways, entrances and driveways are clear
  • Parking is available for our truck
  • Boxes are sealed, labelled and ready
  • Pets and children are safely secured
  • Fragile items are identified to our team
  • Items are packed properly (unless you purchased packing services)

Exclusions and Limitations of Liability

Nothing in these terms operates to exclude any Non-excludable Condition under the Competition and Consumer Act 2010 or equivalent State/Territory legislation if to do so would contravene that statute.

Where the law allows, our liability is limited to supplying the service again or covering the cost of having it supplied again. We exclude:

  • (a)All terms, conditions and warranties implied by statute, general law or custom (except Non-excludable Conditions);
  • (b)All liability in negligence for acts or omissions of us, our employees, agents or contractors; and
  • (c)All liability in contract for consequential or indirect damages, including loss of profits, revenue, use, contract, goodwill, increased cost of working, or damage from third-party claims.

Governing Law

23.1

These terms are governed by Queensland law. Any dispute may be handled through QCAT or another appropriate tribunal.

General
📌

These terms and conditions constitute the entire agreement between the parties and supersede all prior agreements on their subject matter. If any provision is illegal or unenforceable in any jurisdiction, the remaining provisions remain in force.

All waivers must be in writing. A single or partial exercise of a right does not prevent further exercise of that or any other right.

We are entitled to unilaterally amend these terms and conditions where the amendment is reasonable. You will be informed at least two days before any amendment takes effect. If you do not agree, you must terminate the contract and comply with all post-termination obligations.
